A spousal visa allows a citizen of one country to marry
a citizen of another nationality and for that citizen to reside in the
country of their spouse
Example: American marrying a Filipino, Australian
marrying Indonesian, British marrying Thai, Dutch marrying Nigerian etc.
In all the above examples a Spousal visa is needed to
bring the Filipino, Thai, etc into the respective countries USA/UK etc.
These are one of the hardest visa to get (the only visa
which is more difficult is a Settlement /Residents Visa).
The requirements are plenty and the whole process takes
forever and a day and is not cheap.
The following are a list of the requirements that are
most commonly needed.
- Marriage Certificate translated and notarised into
whichever country they will be coming.
- Your employment details ( this pertains to for
example to the American marrying the Filipino etc)
- Home address ( American, etc)
- Financial records for the previous 12 months. (
American, etc)
- Household bills for the previous 12 months
(American ,etc)
- An interview may well be necessary at the local
Embassy/Consulate ( American, British ,Dutch, Australian using the
examples above)
- Photographs /telephone records ( this is normally
needed if you are applying from abroad and do not yet have the marriage
certificate)
- Where and when did the Filipino meet the American
etc
- When did the relationship begin
- Do you plan on having a long term relationship
with the intended spouse
- Proof that you are eligible to be married
Depending upon the country you need to download the
relevant application form or get the form from your local embassy as
different countries have different regulations. A spousal form runs from
anywhere from 5-10 pages normally. You MUST answer all the relevant
questions truthfully.
As long as the person marrying the foreigner can
prove that they are financially stable and secure
enough to look after a dependent then the visa will be issued. The reason
that many spousal visas are rejected is that the government does not believe
that the person wanting to marry the foreigner is financially able to do so.
